    COVENANTS AND RESTRICTIONS

    The purpose of the Homeowners Association being governed by Covenants and Restrictions is to ensure that, not only each individual’s property value will appreciate, but that the Common Areas and Amenities of the subdivision be enhanced.  This is an important selling feature of our community.

     Half Mile Lake Subdivision is governed by recorded Covenants and Restrictions in the name of Half Mile Lake Homeowners Association, Inc., a South Carolina non-profit corporation.  Membership in the Association is mandatory with ownership of property.

     Each homeowner should have received a copy of the recorded Covenants and Restrictions from their attorney at the time of closing.  If you did not receive a copy, please contact the Board of Directors.  We suggest that you obtain a complete copy of these and read them carefully. Homeowners are responsible for knowing and following all Covenants and Restrictions, not just those summarized here.

     Listed below is a brief summary of some of the most important Covenants and Restrictions. 

     1)                 The yearly assessment runs from January 1 through December 31, and is payable on March 1st of each year.  A 1-1/2% per month late fee will be assessed as of April 1st.  If complete amount is not paid when due, the homeowner may be notified that lien proceedings will be filed.  Assessment together with interest, costs associated with lien filing, late fees, and reasonable attorney’s fees will be charged to the homeowner and must be paid before lien is released.

     2)                 The Board of Directors can increase the yearly assessment by 5% without membership vote if deemed necessary.

     3)                 The purpose of the assessment is for promoting the recreation, health, safety and welfare of the residents, enforcing covenants and rules, maintenance, improvement and operation of any amenities, Common Areas including maintaining repair and capital replacement, taxes, insurance (both property and liability), utilities, landscape maintenance, street light expense and various miscellaneous expenses.

      4)                 Special Assessments must be voted on by the membership requiring a 2/3 majority for passage.

     5)                 Architectural Committee is responsible for ensuring compliance with Article VI and VII of the Covenants and Restrictions.  Any and all exterior changes, alterations or additions except normal landscaping (including change of paint color), fences (4 foot wooden or vinyl only), antenna, clotheslines, play houses, satellite dishes (18” or less and out of street view), parking pads (concrete slab only), animal pens/cages, swing sets, etc. shall not commence until plans and specifications have been submitted to the Architectural Committee.  A submittal form is located on our website at www.halfmilelakehoa.com or in your directory.  Please call a member of the Board or Architectural Committee listed in your directory for the correct approval procedures.

      6)                 Minimum square footage for 1 and 1-1/2 story home is 1,650.  Minimum square footage for 2 story home is 1,800. All plans and colors must be approved by Board or Architectural Committee.  

      7)                 No immoral, improper, offensive or unlawful use of property at any time.

      8)                 No signs, placards, election signs, posters, or billboards may be placed on property other than FOR SALE signs.

     9)                 All mailboxes and numbers must be uniform.  Replacement numbers are available through the Board.

     10)             Any camper, boat, trailer, vehicle or items not in daily use must be stored at all times behind closed doors of garage.  Parking on streets should be kept to a minimum for safety purposes.  Parking on yards is not permitted (contact Architectural Committee for information on parking pads) Greenville County Ordinances prohibit parking on the streets.

      11)             Garbage refuse, debris and recycle bins must be stored out of sight from all streets until day of collection, or placed at curb after 6:00 pm on Thursday evenings.  Garbage pickup at curb each Friday except the weeks of November 23rd and December 25th.  In that case, pickup will be on Saturday.  All containers should be returned to storage area within 24 hours.

     12)             Each owner shall keep his or her residence maintained and in good repair; i.e. grass cutting, exterior clean, shutter/door/house painting, and exterior repairs.

     13)             No residence may be leased for less than 6 months and lessee shall be subject to all provisions of Covenants, Restrictions and By-laws.  No homeowner can lease their residence unless they have occupied the home for a period of one year prior.

     14)             All animals should be on a leash or restricted to owner’s property.  Greenville County’s Animal Control Ordinance No. 731 states all cats and dogs must be kept on the owner’s property, or on a leash.  Call Animal Control for details.

      15)             Speed limit is 25 MPH on all streets.
